1. Eligibility

You must be at least 18 years old to create an administrator, teacher, or institutional account unless authorized by a school or legal guardian.

Students under 13 may only access the platform through an authorized educational institution, teacher, parent, or legal guardian where legally permitted.

By using the platform, you represent that you have the legal authority to do so.

2. Services Provided

Judicor provides educational tools including but not limited to:

  • Exam creation
  • Exam administration
  • Classroom management
  • Student assessments
  • Grade tracking
  • Teacher dashboards
  • Institutional academic workflows
  • Subscription-based platform access

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. Account Registration

You are responsible for:

  • Maintaining accurate account information
  • Protecting your login credentials
  • All activity under your account
  • Promptly notifying us of unauthorized access

We reserve the right to suspend or terminate accounts for security concerns or violations of these Terms.

4. Payments and Billing

Certain features require paid subscriptions or one-time payments.

Payments are securely processed through Stripe.

By purchasing a subscription, you agree:

  • To provide accurate billing information
  • To authorize recurring charges where applicable
  • That subscription fees are billed according to your selected plan

Failure to pay may result in suspension or termination of access.

5. Refund Policy

Unless otherwise stated in a separate written agreement, subscription payments are generally non-refundable.

Refund requests may be reviewed on a case-by-case basis for billing errors or exceptional circumstances.

We reserve sole discretion regarding refunds.

6. Acceptable Use

You agree not to:

  • Violate any applicable laws
  • Upload malicious code or harmful content
  • Attempt unauthorized access to accounts or systems
  • Interfere with platform security
  • Abuse exam integrity systems
  • Use the platform for cheating, fraud, or academic misconduct
  • Impersonate another person or institution
  • Reverse engineer proprietary systems without authorization

Violation may result in immediate account termination.

7. Educational Responsibility

Teachers, schools, and institutions are responsible for:

  • Proper administration of exams
  • Student consent where required
  • Compliance with FERPA, COPPA, and local education laws
  • Academic integrity enforcement

Judicor provides tools but does not act as the educational authority.

8. Intellectual Property

All platform content, software, branding, features, design systems, and proprietary workflows remain the exclusive property of SilicaCreative unless otherwise stated.

Users retain ownership of their uploaded educational content, exams, and academic materials, while granting us a limited license to host and process such content to provide the Services.

You may not copy, resell, or commercially exploit the platform without written permission.

9. Privacy

Your use of the Services is also governed by our Privacy Policy.

By using Judicor, you consent to our collection and use of data as described in the Privacy Policy.

10. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted access.

We are not liable for:

  • Downtime
  • Maintenance interruptions
  • Service outages
  • Third-party provider failures
  • Internet disruptions

11. Limitation of Liability

To the fullest extent permitted by law, SilicaCreative shall not be liable for:

  • Indirect damages
  • Lost profits
  • Data loss
  • Academic outcomes
  • Institutional decisions
  • Business interruption
  • Third-party misuse

Our total liability shall not exceed the amount paid by you to us during the previous 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless SilicaCreative from claims, damages, liabilities, and expenses arising from:

  • Your use of the Services
  • Violation of these Terms
  • Misuse of educational records
  • Violations of law or third-party rights

13. Termination

We may suspend or terminate access at any time for:

  • Violations of these Terms
  • Fraudulent activity
  • Security risks
  • Legal compliance obligations
  • Non-payment

You may stop using the Services at any time.

Termination does not remove payment obligations already incurred.

14. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Any disputes shall be resolved in the appropriate courts located in Wyoming.

15. Changes to Terms

We may update these Terms from time to time.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
